The I-9 form has been a necessary requirement for seeking employment ever since 1986. Since then, it has been the main tool used to wipe out illegal labor. Even still, immigrants find ways to falsify documents and employers are still willing to hire them regardless just because in most cases the labor is so unbelievably cheap. If caught however, the I-9 form provides solid, concrete evidence to return to and prove that the company knowingly hired an illegal immigrant.

I-9 compliance is necessary to keep your business in good standing. The responsibility for ensuring all rules are followed falls upon both the employer and the applicant. It is required of the employer to oversee the first steps of the form and confirm that all areas are filled out correctly. This is to ensure that the employer is aware of anything and everything that is being put into the form. This is also a safety net in case the company is discovered to have hired illegal workers, there is no way that the employer can claim that he had no knowledge that the individual was illegal. Both parties would be equally responsible for breaking the law and would result almost immediately in deportation, fines, and close monitoring throughout the foreseeable future. Considering all of the fines and penalties, is it even worth the short term benefits of cheap illegal labor?

There are many ways for illegal’s looking for work to someway get around the I-9 form. For example, many small landscaping companies often pay their employees under the table so that they remain invisible to the government. However, this presents even more problems regarding uninsured employees and accidents that occur while working. This can lead to even more financial losses because of the medical bills, possible fines, and once again deportation. Some immigrants obtain fake birth certificates, fake driver’s licenses, and all other types of falsified documents. This makes detecting illegal workers much more difficult, but on the other hand can result in the most severe punishment including possible imprisonment. Imprisonment of illegal immigrants puts even more strain on the economy in order to keep someone in jail who technically should not even be in the country.

The I-9 from is set up to ensure that only legal citizens are able to get jobs, but with immigrants willing to work so cheaply, people will always hire them. With the penalties and fines already in place, it’s really up to the employers to regulate themselves and make the right decision.
